Whitehead points out in this week&#8217;s vodcast, what has been made clear, is that the 1% is protected by its own security force—the police—funded ironically enough by the very 99% against whom they are waging war with pepper spray, rubber bullets, tear gas and other instruments of compliance.</div>

<p>America&#8217;s so-called war on terror, which it has relentlessly pursued for the past ten years, has forever altered the political and legal landscape of our country. It has chipped away at our freedoms and is unraveling our Constitution. Even now, with Osama bin Laden having been killed and al Qaeda dismantled by a series of <a href="http://www.washingtonpost.com/world/national-security/al-qaeda-targets-dwindle-as-group-shrinks/2011/11/22/gIQAbXJNmN_story.html" target="_hplink">high-profile assassinations</a>, the war hawks continue to rattle their sabers. Yet while more and more Americans join the call for a de-escalation of military actions abroad, those clamoring for war have turned their focus inwards. As Senator Lindsay Graham <a href="http://www.adn.com/2011/12/02/2201260/senate-proves-we-should-fear-ourselves.html" target="_hplink">recently remarked</a> as an explanation for his support of legislation allowing for the indefinite detention of Americans, &#8220;Is the homeland the battlefield? You better believe it is the battlefield.&#8221;</p>

<p>America has indeed become the new battleground in the war on terror. In light of this, you can rest assured that there will be no restoration of the civil liberties jeopardized by the USA Patriot Act and other equally subversive legislation. Instead, those in power will continue to sanction ongoing violations of our rights, relying on bureaucratic legalese to sidestep any concerns that might be raised. The National Defense Authorization Act of 2012, which was <a href="http://www.theatlantic.com/politics/archive/2011/12/ceding-liberty-to-terror-senate-votes-against-due-process-rights/249388/" target="_hplink">passed by the Senate</a> with a vote of 93 &#8211; 7, is a perfect example of this. Contained within this massive defense bill is a provision crafted by Democrat Charles Levin and Republican John McCain which mandates that anyone suspected of terrorism against the United States be held in military custody indefinitely. This provision extends to American citizens on American territory. The bill also renews the Authorization to Use Military Force (AUMF) which was passed in 2001, shortly after the 9/11 attacks. In addition to renewing the AUMF, it extends its provisions to include military action against those who &#8220;substantially support&#8221; al Qaeda, the Taliban or &#8220;associated forces.&#8221; And to cap it off, <a href="http://www.salon.com/2011/12/01/congress_endorsing_military_detention_a_new_aumf/singleton/" target="_hplink">the bill</a> enhances restrictions against transferring detainees being held in Guantanamo Bay to the continental United States.</p>
<p>Taken collectively, these provisions reorient our legal landscape in such a way as to ensure that martial law, rather than the rule of law &#8212; our U.S. Constitution, becomes the map by which we navigate life in the United States. In short, this defense bill not only decimates the due process of law and habeas corpus for anyone perceived to be an enemy of the United States, but it radically expands the definition of who may be considered the legitimate target of military action. If signed into law by President Obama, this bill will not only ensure that we remain in a perpetual state of war &#8212; with this being a war against the American people &#8212; but it will also institute de facto martial law in the United States. Although the 1878 Posse Comitatus Act placed strong restrictions on how and when the U.S. military may be used on American soil, the language of this bill supersedes <a href="http://www.louisville.com/content/sen-rand-paul-fights-against-martial-law-legislation-arena" target="_hplink">Posse Comitatus</a>, empowering the president to unilaterally impose martial law at any time of his choosing. This legislation signals the end of the rule of law in America.</p>
<p>Even the slight glimmer of hope that this march towards martial law might be thwarted was quickly extinguished by a Congress that broke its partisan gridlock long enough to overwhelmingly defeat efforts by Senators Mark Udall and Diane Feinstein to lessen the law&#8217;s damage. Udall&#8217;s proposal to strike the provision allowing for those suspected of terrorism to be held indefinitely was <a href="http://thehill.com/blogs/floor-action/senate/195949-senate-defeats-amendment-to-remove-terrorist-detainee-language" target="_hplink">struck down</a> 61-37, while Feinstein&#8217;s <a href="http://www.senate.gov/legislative/LIS/roll_call_lists/roll_call_vote_cfm.cfm?congress=112&amp;session=1&amp;vote=00213" target="_hplink">stipulation</a> that the provision apply only to non-Americans captured &#8220;abroad&#8221; was <a href="http://news.antiwar.com/2011/12/01/senate-rejects-limits-on-domestic-military-detention/" target="_hplink">shot down</a> 55-45. It&#8217;s particularly telling that two such seemingly disparate groups of politicians &#8212; ostensibly liberal Democrats concerned with the rule of law and ostensibly conservative Republicans concerned with shrinking government &#8212; who spent two months disagreeing about whether or not to raise America&#8217;s debt ceiling, an ultimately arbitrary and unimportant decision, took less than a week to find consensus on upending the rule of law and radically extending the government&#8217;s power.</p>
<p>The fact that our elected representatives &#8212; public servants entrusted with acting in our best interests&#8211;are putting forth legislation which endangers the right to due process, a founding principle of this nation, is alarming, but perhaps not all that surprising. We have witnessed the pieces being put into place for years now with little outcry from the American people. The perpetual war on terror has provided those in power with the perfect means by which to ratchet up the fear, all the while slowly eroding our freedoms.</p>
<p>I have yet to see any credible rationale for the presence of these martial law provisions in the defense bill. After all, existing laws and government procedures already address all contingencies for handling any actual enemies of the United States. Even the courts have helped to reinforce these ongoing breaches, ruling that it&#8217;s a <a href="http://news.yahoo.com/obama-lawyers-citizens-targeted-war-us-154313473.html" target="_hplink">prerogative of the president</a>, not the judiciary, to determine how enemies of the United States will be treated in custody and what type of trial they will receive, if any. Moreover, we have not seen a terrorist attack on American soil since 9/11. Yet with America pulling out of Iraq at the end of the year, and slowly ratcheting down its commitment to Afghanistan, the military industrial complex that feeds off of war is increasingly making its presence felt on American soil.</p>
<p>In fact, Congress is only too willing to sell us to the highest bidder, and they are doing it using the same rhetoric they trotted out to justify past debacles such as the invasion of Iraq, the use of waterboarding against detainees at Guantanamo Bay, the torturing of prisoners at Abu Ghraib, the installation of <a href="https://www.propublica.org/article/u.s.-government-glossed-over-cancer-concerns-as-it-rolled-out-airport-x-ray" target="_hplink">cancer-causing</a> body scanners in American airports, and the authorization of government agencies spying on Americans.</p>
<p>Is there any hope of thwarting this legislation? In light of the fact that the defense bill, which has passed the Senate, must still be reconciled with the House of Representatives&#8217; version, it is possible that the offending provisions could be deleted. The Obama administration has also suggested that the president might veto the bill in its entirety. Yet Obama&#8217;s veto threat doesn&#8217;t actually stem from a concern for the rule of law so much as it has to do with his attempt to amass greater presidential powers.</p>
<p>The situation presents us with something of a catch-22. If the bill is signed into law as it currently exists, anyone (including Americans) in any part of the world (including the United States) who is &#8220;suspected&#8221; of terrorism may be detained indefinitely and without trial by the United States military. If the bill is altered so as to remove these provisions, this will still probably occur, as the executive branch has, in the years since 9/11, carved out broad, overreaching, and unconstitutional powers for itself when it comes to pursuing military and police actions against perceived enemies. A case in point is the government-sanctioned assassination of U.S. citizen Anwar al-Awlaki, buttressed by the fact that two of <a href="http://news.yahoo.com/obama-lawyers-citizens-targeted-war-us-154313473.html" target="_hplink">Obama&#8217;s top lawyers</a> have publicly stated that any U.S. citizen allied with al Qaeda is a legitimate military target.</p>
<p>Thus, while the passage of this defense bill would be the final nail in the coffin for the rule of law in America, for all intents and purposes, the rule of law is already on life support. Of all of the egregious actions of the United States government in the past decade, this may be the most outrageous. That our lawmakers, sworn to uphold the Constitution, would even consider voting on a provision that completely eviscerates the rule of law is appalling. Unfortunately, this is the state of our government, a government that has been allowed to run wild since 9/11.</p>
<p>As we ratchet down the wars abroad, we must call upon our leaders to shore up the rule of law and civil liberties at home. There is absolutely no excuse for the continued abuse of power that we, as a nation, have endured for so long.</p>

<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">1. The protest at which UC Davis police officers used pepper spray and batons against unresisting demonstrators was an entirely nonviolent one.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">None of the arrests at UC Davis in the current wave of activism have been for violent offenses. Indeed, as the New York Times reported this morning, the university’s administration has “reported no instances of violence by any protesters.” Not one.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">2. The unauthorized tent encampment was dismantled before the pepper spraying began.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">Students had set up tents on campus on Thursday, and the administration had allowed them to stay up overnight. When campus police ordered students to take the tents down on Friday afternoon, however, most complied. The remainder of the tents were quickly removed by police without incident before the pepper spray incident.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">3. Students did not restrict the movement of police at any time during the demonstration.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">After police made a handful of arrests in the course of taking down the students’ tents, some of the remaining demonstrators formed a wide seated circle around the officers and arrestees.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">UC Davis police chief Annette Spicuzza has claimed that officers were unable to leave that circle: “There was no way out,” she told the Sacramento Bee. “They were cutting the officers off from their support. It’s a very volatile situation.” But multiple videos clearly show that the seated students made no effort to impede the officers’ movement. Indeed, Lt. Pike, who initiated the pepper spraying of the group, was inside the circle moments earlier. To position himself to spray, he simply stepped over the line.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">4. Lt. Pike was not in fear for his safety when he sprayed the students.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">Chief Spicuzza told reporters on Thursday that her officers had been concerned for their safety when they began spraying. But again, multiple videos show this claim to be groundless.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">The most widely distributed video of the incident (viewed, as I write this, by nearly 700,000 people on YouTube) begins just moments before Lt. Pike begain spraying, but another video, which starts a few minutes earlier, shows Pike chatting amiably with one activist, even patting him casually on the back.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">The pat on the back occurs just two minutes and nineteen seconds before Pike pepper sprayed the student he had just been chatting with and all of his friends.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">5. </span></span><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">University</span></span><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;"> of </span></span><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">California Police</span></span><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;"> are not authorized to use pepper spray except in circumstances in which it is necessary to prevent physical injury to themselves or others. </span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">From the </span></span><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">University</span></span><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;"> of </span></span><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">California</span></span><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">’s Universitywide Police Policies and Administrative Procedures: “Chemical agents are weapons used to minimize the potential for injury to officers, offenders, or other persons. They should only be used in situations where such force reasonably appears justified and necessary.”</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">6. UC police are not authorized to use physical force except to control violent offenders or keep suspects from escaping.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">Another quote from the UC’s policing policy: “Arrestees and suspects shall be treated in a humane manner … they shall not be subject to physical force except as required to subdue violence or ensure detention. No officer shall strike an arrestee or suspect except in self-defense, to prevent an escape, or to prevent injury to another person.”</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">7. The UC </span></span><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">Davis</span></span><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;"> Police made no effort to remove the student demonstrators from the walkway peacefully before using pepper spray against them.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">One video of the pepper-spray incident shows a group of officers moving in to remove the students from the walkway. Just as one of them reaches down to pick up a female student who was leaning against a friend, however, Lt. Pike waves the group back, clearing a space for him to use pepper spray without risk of accidentally spraying his colleagues.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">8. Use of pepper spray and other physical force continued after the students’ minimal obstruction of the area around the police ended.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">The line of seated students had begun to break up no more than eight seconds after Lt. Pike began spraying. The spraying continued, however, and officers soon began using batons and other physical force against the now-incapacitated group.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">9. Even after police began using unprovoked and unlawful violence against the students, they remained peaceful.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">Multiple videos show the aftermath of the initial pepper spraying and the physical violence that followed. In none of them do any of the assaulted students or any of the onlookers strike any of the officers who are attacking them and their friends.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">10. The students’ commitment to nonviolence extended to their use of language.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">At one point on Thursday afternoon, before the police attack on the demonstration, a few activists started a chant of “From Davis to </span></span><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">Greece</span></span><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">, fuck the police.” They were quickly hushed by fellow demonstrators who urged them to “keep it nonviolent! Keep it peaceful!”</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">Their chant was replaced by one of “you use weapons, we use our voice.”</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">Six and a half minutes later, the entire group was pepper sprayed.</span></span></p>
<p class="MsoNormal"><span style="font-family: Arial; font-size: x-small;"><span style="font-size: 10.0pt; font-family: Arial;">Monday Update | One of the most common criticisms of this post in comments has been the claim that because the UC Davis protesters encircled police in an attempt to (at least symbolically) prevent the arrest of their fellow students, their protest cannot be considered nonviolent. I’ve addressed this question in a followup post this morning.</span></span></p>

Chase went off without a hitch, but by the time the protesters made it to a Citibank branch there was trouble.</p>

<p>This was an interesting interaction that was recorded by someone on the World Freeman Society forum.</p>
<p><em>Ok, so here’s the way it went down… I recorded it on my cell phone but it’s an old phone and I don’t have any way to put it on my computer…</em></p>
<p><em>I was traveling to Calgary in my girlfriend’s truck (which is registered, insured, etc) and I obviously do not carry a “Driver’s License” anymore….</em></p>
<p><em>I was going about 130 in a 110 zone and sure enough the lights started flashing in my rear view mirror… The highway sherriff (a female) approaches my window…</em></p>
<p><em>Me: Good morning officer! (with a big smile) Are you a peace officer?<br />
Her: Yes I am<br />
Me: Have you observed me breach the peace today?<br />
Her: You were speeding, 131 in a 1… (I cut her off)<br />
Me: Violating a statute is not breaching the peace. Have you observed me breach the peace today?<br />
Her: I need to see your… (I cut her off again)<br />
Me: You don’t need to see anything, have you observed me breach the peace today?<br />
Her: I need to see your…. (again cut off)<br />
Me: According to the constitution act of 1982 I have a right to be free from interference with my personal affairs and the right to refuse interaction with a peace officer who has not observed me breach the peace, Is that correct?<br />
Her: Well… (cut off yet again)<br />
Me: Am I being detained?<br />
Her: Sir I need to… (cut off)<br />
Me: No, have you observed me breach the peace?<br />
Her: No but you were (cut off)<br />
Me: Am I being detained?<br />
Her: Sir I… (you know by now that I cut her off again)<br />
Me: Am I being detained?<br />
Me: Am I free to go?<br />
Her: No I need to (again)<br />
Me: Am I being detained? I have a right against this. Am I being detained?<br />
Her: No I just need (yup, again)<br />
Me: So if I’m not being detained then I’m free to go right? Am I free to go?<br />
Her: No I need (haha ya, again)<br />
Me: If I’m not free to go then I’m being detained right? Am I being detained?<br />
Her: No you’re not I just… (you get the picture)<br />
Me: If I’m not being detained then I’m free to go… (starting truck again)<br />
Her: (with hand on gun) Sir I need you to step… (wanted to say “out of the vehicle” but I cut her off again)<br />
Me: If I’m not being detained then I am free to go right? Am I free to go or am I being detained?<br />
Her: No…. (cut off)<br />
Me: So if I’m not being detained and I’m not free to go what am I? I’m gonna drive away now (I put the truck in gear)<br />
Her: (almost yelling at this point) Sir I need you to!… (cut off)<br />
Me: You don’t need anything, I’m going to drive away now (I know I shouldn’t have used the word drive but whatever)</em></p>
<p><em>So at this point I let my foot off the brake and coasted forward a few feet. She just stood there with the most CONFUSED look on her face, and I had butterflies in my stomach that I thought were going to break through the skin and fly away…<br />
I was expecting her to come chase me down and taser me or something but I looked in the mirror and she was still just standing there with a look that clearly said “What the hell just happened here?”</em></p>

<p>In other words, <strong>don&#8217;t give honor to those who abuse their power.</strong> Don&#8217;t even fear them. And don&#8217;t submit to those that cause you to fear for doing good. What is the difference between that peace officer coming up to you with a gun and a civilian, or a Nazi, or a Muslim, or a fanatical Christian coming up to you with a gun and a little intimidation?</p>
<p>This guy, in my humble opinion,  is not far from the kingdom of Heaven.</p>

<p>A prelude to God&#8217;s wrath is calling evil good and good evil as it was in the day of Isaiah just before Israel went into judgment. Many Christians I know have come to calling evil good and good evil without really knowing what they do. They tear down society but think they do good.</p>

<p>This attitude, this ignorance is repugnant to God and is a spiritual sickness found in the church.  It must be confronted and rooted out.</p>

<p>And regarding speeding; don&#8217;t strain at a gnat and swallow a camel.  Do you know someone that speeds?  Do they seem to be putting the nation at risk of losing its liberty and justice for all?  But corrupt people in positions of public service do put the country at risk.</p>
